About the Webinar
Technology in the practice of law has grown by leaps and bounds in the past decade. These technological advances allow law firms to reduce costs, increase efficiency, and provide better client service. However, with these benefits come certain responsibilities and requirements that lawyers must become familiar with and adhere to.
This presentation will explore the interplay between ethics and the use of technology in a collection practice. Discussion will cover the use of technology when contacting and investigating debtors, and the use of technology by lawyers to market themselves and their collection practice.
About the Speakers
As a managing partner with Bernstein-Burkley, P.C., Robert S. Bernstein regularly serves as a mediator and counsel to commercial landlords, equipment lessors, bankruptcy trustees, creditors’ committees, creditors and reorganizing businesses in proceedings, concentrating in the many facets of bankruptcy and commercial law. He has extensive experience in credit recovery matters, including collection, secured transaction and mortgage foreclosure.
Mr. Bernstein is certified in business bankruptcy and creditors’ rights law from the American Board of Certification, and is admitted to the State Bars of Pennsylvania, West Virginia, Florida and New York. He writes and lectures for local and national groups on matters of collection, bankruptcy, business law and professional ethics.
Mr. Bernstein was named a Fellow by the American College of Bankruptcy, joining the College’s Class XXVII. The prestigious honor is awarded only to professionals who have shown the highest standard of professionalism, ethics, character, integrity, professional expertise and leadership contributing to the enhancement of bankruptcy and insolvency law and practice. Mr. Bernstein has been named as a “Pennsylvania Super Lawyer” every year since 2004. For nine consecutive years, he has also been recognized by Best Lawyers® for his work in bankruptcy, creditors’ rights, insolvency and reorganization law, and bankruptcy litigation. He was also named Best Lawyers® 2016 Litigation - Bankruptcy "Lawyer of the Year" in Pittsburgh.
Kirk B. Burkley is a Managing Partner with Bernstein-Burkley, P.C. He supervises the firm’s Bankruptcy and Restructuring practice group and heads the firm’s Preference Defense Team. Mr. Burkley is experienced in representing secured and unsecured creditors in bankruptcy, financial restructuring and workout situations, including the representation of numerous unsecured creditors’ committees, equipment lessors, financial institutions and commercial landlords. Mr. Burkley has also represented owners, contractors and subcontractors in construction disputes and regularly advises developers and lenders on large real estate transactions. Additionally, he has developed unique experience in many facets of shareholder litigation in different industries.
Mr. Burkley is certified in business bankruptcy and creditors’ rights law from the American Board of Certification. He has quickly been defined as a well-respected lawyer in his field, as is evidenced by being named a “Pennsylvania Rising Star” from 2005 to 2012 and a “Super Lawyer” since 2013 by Philadelphia Magazine. He has been named as one of “The Best Lawyers in America” since 2011 by his peers in the field of Bankruptcy.
Raymond P. Wendolowski is an Associate with Bernstein-Burkley’s Creditors’ Rights group. His practice focuses primarily on commercial collection litigation. Ray is responsible for the filing and defense of mechanics’ liens, foreclosure actions, replevins, bond litigation, involuntary bankruptcies and other credit-related matters. He is involved with a number of professional organizations, including the Allegheny County Bar Association (ACBA) where he graduated the Bar Leadership Initiative program and is a current member of the Education Committee.
