About the Webinar
Credit professionals commonly rely on personal guaranties as a primary method of protection when commencing a business relationship with a new customer whose creditworthiness is at issue, or when existing customers start deviating from timely payment practices. While personal guaranties are certainly a valuable component of the credit manager’s toolbox, they suffer from two considerable deficiencies: (1) they can be difficult and costly to enforce; and (2) collectability is often challenging, particularly when the fortunes of the guarantor are intertwined with those of the customer. During this interactive webinar, Thomas Fawkes and Brian Jackiw of Goldstein & McClintock LLLP will discuss a variety of credit enhancements that are available to bolster the likelihood of recovery in the event of a customer default, bankruptcy or liquidation. When properly structured, these enhancements, which include security interests and deposits, standby letters of credit and credit insurance, are often preferable to guaranties because they are frequently easy to collect upon, and may even be bankruptcy-proof.
